de Israel 2023 judicial reforma debate concerned who sets o limits on governo power. Israel has no single, completed written constitution. Instead, o Knesset has enacted Basic Laws over time, e o Suprema Corte has interpreted their status e o limits they place on ordinary legislation. O governo proposals iria have changed how tribunais revisão governo action, how juízes are selected, e how legal advisers guide ministros.
Como Basic Laws became constitutional lei
Israel has no single, completed written constitution. O Knesset has instead enacted constitutional chapters as Basic Laws over time. In 1992, o Knesset enacted Basic Lei: Human Dignity e Liberty e a Basic Lei protecting o right to pursue a profession. In United Mizrahi Bank v. Migdal Cooperative Village (1995), o Suprema Corte considered whether Basic Laws had superior status e whether o Knesset could limit its own legislative authority. O judgment established o basis para reviewing ordinary laws against o protected direitos in those Basic Laws.
This development did not produce a complete constitution or settle every question about o Knesset's authority. Basic Lei: O Judiciary, one de these constitutional chapters, sets out o tribunais' independence e appointment framework in its Knesset text. That unfinished structure meant that proposals to amend a Basic Lei raised a special question: whether a temporary parliamentary majority could alter o rules that constrain governo.
O que o 2023 package proposto
Justice Minister Yariv Levin announced a package in janeiro 2023. Its principal proposals included changing o Judicial Selection Committee, restricting tribunais' use de razoabilidade revisão, creating an override mechanism para some laws, e changing o status de governo legal advisers. These were separate proposals com different legislative histories; only o razoabilidade emenda became lei in 2023. For o appointment dispute, see how o proposto Judicial Selection Committee iria change. For o lei that did pass, see what o razoabilidade emenda said.
Por que o design question mattered
Supporters said elected officials needed greater control over decisões that shaped public policy e that juízes had gained excessive influence. Opponents answered that de Israel parliamentary system gives a governing coalition control de both o executive e a Knesset majority, so an independent tribunal e professional legal advice supply checks when o same coalition controls both. O disagreement foi therefore about o institutional rules themselves: whether political accountability through elections foi sufficient, or whether judicial revisão e independent appointments were also necessary constraints.
O Suprema Corte's janeiro 2024 ruling sharpened that dispute. Twelve de 15 justices held that o Corte could revisão Basic Laws in exceptional cases; eight justices held that o razoabilidade emenda crossed that boundary. O Corte's reasons e votação are set out in o janeiro 2024 decisões.
